HSTPA (Housing Stability & Tenant Protection Act)
The sweeping 2019 New York law that reshaped rent regulation, ending vacancy deregulation and capping improvement increases.
The Housing Stability and Tenant Protection Act of 2019 was the most significant rewrite of New York rent law in a generation. It permanently extended the rent-regulation statutes, eliminated high-rent and high-income vacancy deregulation (so units can no longer simply "leave" stabilization by crossing a rent threshold), and abolished the vacancy bonus that let landlords raise rent sharply between tenancies.
HSTPA also slashed what landlords can recover from MCIs and IAIs — lower caps, longer amortization, and an expiry on the surcharge — and lengthened the lookback period for overcharge claims. Many of the compliance ceilings a modern NYC rental system enforces trace directly to this statute.
In short, HSTPA is the reason a rent-stabilized unit stays stabilized, why improvement increases are bounded and temporary, and why getting a legal rent wrong carries real lookback exposure.
