Rent Overcharge
Charging more than a rent-regulated unit’s legal rent — exposing the landlord to a refund plus, in willful cases, treble damages.
A rent overcharge is collecting more than the legal regulated rent on a rent-stabilized or rent-controlled apartment. A tenant can file an overcharge complaint with DHCR or sue in court; if it succeeds, the landlord must refund the excess, and where the overcharge was willful, damages can be trebled.
HSTPA lengthened the lookback period courts and DHCR use to examine a unit’s rent history, which means an unexplained jump in the legal rent years ago can still come back to bite the current owner. This is why a documented chain from the registered base rent through every permitted increase matters so much.
For a brokerage, overcharge exposure is the core risk a compliance-first rent gate is built to prevent: it stops a lease from writing a rent above the applicable ceiling, and logs any admin override with a reason.
